Cookie policy

1. What are cookies?

Cookies are small text files that websites you visit send to your device (computer, tablet, smartphone), where they are stored before being re-sent to the same sites on your next visit. Cookies allow websites to remember your actions and preferences (such as login credentials, language, font size, and other display settings) so you don't have to re-enter them.

Cookies can be installed by the site the user is visiting (“first-party cookies”) or by different sites or web servers (“third-party cookies”).

2. Legal basis and applicable regulations

This document is drawn up in compliance with:

• Regulation (EU) 2016/679 (GDPR), in particular articles 13 and 14;

• Legislative Decree 30 June 2003, n. 196 (Privacy Code), as amended by Legislative Decree 101/2018;

• Provision of the Guarantor for the protection of personal data of 10 June 2021 (“Guidelines on cookies and other tracking tools”);

• EDPB Recommendations 03/2022 on consent.

The Italian Data Protection Authority, with its provision of June 10, 2021, clarified that technical cookies (including strictly necessary functional cookies) do not require user consent, while third-party analytical cookies and profiling/marketing cookies require free, specific, informed, and unequivocal consent, expressed before they are stored.

3. Types of cookies used by the site

3.1 Essential technical cookies

Essential technical cookies are necessary for the proper functioning of the site and for managing consent. They do not collect information used for profiling or marketing purposes. Pursuant to the 2021 Italian Data Protection Authority provision, these cookies do not require user consent and cannot be disabled without compromising the usability of the site.

3.2 Analytical (statistical) cookies

Analytics cookies are used to collect aggregate information on website usage, with the aim of understanding navigation patterns and improving its performance. The site uses Matomo, an open-source web analytics platform that runs on servers owned by the group ([paulaner-gruppe.de]), without transferring data to external third parties.

Pursuant to the 2021 provision by the Italian Data Protection Authority, first-party or similar analytical cookies (i.e., managed on proprietary infrastructure, with data not shared with third parties) can be treated as technical cookies and do not require consent, provided that adequate data minimization measures are adopted (e.g., IP anonymization, absence of cross-site tracking).

The Owner declares that Matomo is configured with the following minimization measures:

• anonymization of the user's IP address (truncation of the last octet);

• disabling cross-site tracking;

• data not shared with third parties.

This site does not use profiling cookies, marketing cookies, or third-party social media cookies. Cookies that track users on sites other than the one they're visiting are not installed, nor are cookies used to display behavioral advertising.

5. Duration of cookies

Cookies are divided into:

• Session cookies: these are automatically deleted when the browser is closed and are not stored permanently on the user's device (e.g. MATOMO_SESSID, _pk_ses.*, _pk_cvar.*, _pk_hsr.*);

• Persistent cookies: they remain stored on the user's device for a specified period or until they are manually deleted (e.g. c3kie: 180 days; pk_id.*: 13 months; _pk_ref.*: 6 months).

6. Consent management and preferences

Upon first accessing the site, users are presented with an information banner that allows them to express their preferences regarding the use of non-technical cookies. Consent, where required, can be obtained using tools that guarantee:

• freedom: no non-technical cookies are installed before consent is given;

• specificity: consent is differentiated by cookie category;

• information: the banner refers to this Cookie Policy;

• revocability: consent can be revoked at any time as easily as it was given.

To modify or revoke your expressed preferences, you can:

• use the available preference management tool [insert link or method of access to the site's cookie settings];

• configure your browser to block or delete cookies (see article 7 below);

• exercise the rights referred to in art. 8 of this policy.
